Summary

From the available categories of damages to the applicability of certain immunities, the rules and remedies vary greatly between different states (and provinces). For better or worse, the “where” can be more important than the “what” in personal injury cases.

Just because an incident happens in Washington doesn’t mean that the lawsuit can or will take place here. And it certainly doesn’t mean that Washington law will apply. Defendants, distributors, and manufacturers residing out of state can provide both pitfalls and opportunities when it comes to determining where a lawsuit should take place and what law will apply. This CLE addresses how to identify and address those pitfalls and opportunities.
