Welcome to the Washington State Association for Justice (“WSAJ”) Web site. The term “Web site” or “site” includes the WSAJ pages, database resources and e-mail List Serves. WSAJ has prepared this Web site as a service to our Members and other Internet users. By using this site, you signify your agreement to these Terms of Use. If you do not agree to these terms, you are not authorized to use this site. Unauthorized users are trespassing. We reserve the right, at our discretion, to add, remove or modify portions of these terms at any time. Please check periodically for changes. Your continued use of this site following the posting of such changes will mean you accept the changed terms.

Access

Portions of this site are open to the public; portions are open only to WSAJ Members; portions are open only to WSAJ Plaintiff Members; and portions are open only to WSAJ Eagle Members. You are not permitted to enter a restricted area unless you are an existing member of the posted group. Breach of this Web site’s restricted areas may subject you to criminal or civil liability. Breach of these Terms of Use may result in your being prohibited from accessing the site and may also subject you to criminal or civil liability.
Disclaimer Applicable to All Areas

Restrictions on Posting Materials

You are entirely responsible for all content that you upload, post, e-mail or otherwise transmit via the site. Although WSAJ does not generally control postings on the site, WSAJ retains the right to remove any material that violates any of the Terms of Use or is otherwise objectionable. WSAJ may preserve content off-site and may disclose content. You agree not to use the site to upload, post, e-mail or otherwise transmit:
  • Content that is threatening, abusive, harassing, defamatory, libelous, pornographic, obscene, invasive of another’s privacy, otherwise tortious or unlawful, hateful, or is racially or ethnically objectionable.
  • Material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment, or which negatively affects other users’ ability to upload, download, communicate in real time, or utilize features as they have been designed to function.
  • Material that violates a copyright, license, right of privacy, right of publicity, trademark, privilege, right of confidentiality, fiduciary obligation, trade secret, employment obligation, agreement or other restriction on use. 
  • Material whose use is authorized only when accompanied by a copyright notice, source credit or other required marking or language, unless accompanied by the required marking or language.
  • Content that constitutes, encourages or provides instructions in committing a criminal offense, violation of another’s rights, conduct that is likely to give rise to liability or violation of Court Rules or Rules of Professional Conduct, or violation of these Terms of Use.
  • Advertisements, solicitations, promotions or announcements of goods or services for commercial purposes, except for the purpose of sharing information with users about third party services that are likely to be of interest to such users. In the event you do have a financial interest, you must disclose it. 
  • Material that contains known falsehoods (unless for the purpose of disclosing and pointing out such falsehoods), including use of inaccurate identification of content, author, source, your identity or affiliation.
  • Content outside the stated purpose and scope of the area to which it is uploaded.

By uploading to the Web site or transmitting material via the Web site you do so at your own risk and expense with full knowledge of these Terms of Use. WSAJ will notify users of their breach of these Terms of Use when WSAJ learns and has reasonable evidence or confirmation of a breach. WSAJ does not undertake in any other manner to protect material posted or transmitted by users. If another user violates the copyright or other restriction on use applicable to material you have posted or transmitted, WSAJ will cooperate with your enforcement efforts by providing you nonprivileged information easily available to WSAJ from its records. WSAJ does not commit to undertake any enforcement efforts itself with respect to such violations, but may bar violators and the entity with which the violator is associated from the Web site and from WSAJ membership.


Additional Provisions for Members or Plaintiff - Only Areas

These areas of the Web site have been prepared and reserved by WSAJ as a service to our Members. WSAJ does not control all content posted on this site and does not guarantee the completeness, current validity, accuracy, integrity, reliability or quality of such content. Use is subject to the same Disclaimer and Restrictions on Posting Materials as are applicable to the public portion of the Web site, except as modified in this section of the Terms of Use.

Only Members of WSAJ and their staff may use these areas of the site. Users must first register online and then access the Members-Only areas by log-in with your user name and password. You may not allow others to use your user name for access or continuation of use after your log-in. List Serves are subject to the additional List Serve Terms of Use.

Additional Provisions for Eagle Members - Only Areas

These areas of the Web site have been prepared and reserved by WSAJ as a service to our Eagle Members. The primary purpose of this portion is for Eagle Members to share information about recent developments in the law and court rules, share work product that is not subject to client privilege, and confer with each other confidentially. WSAJ does not control all content posted on this site and does not guarantee the completeness, current validity, accuracy, integrity, reliability or quality of such content. Use is subject to the same Disclaimer and Restrictions on Posting Materials as are applicable to the other portions of the Web site and the Additional Provisions for Members-Only areas, except as modified in this section of the Terms of Use.

Access: Only Eagle Members of WSAJ and their staff may use these areas of the site. Users must first register online. You may then access the Members-Only areas by log-in with your user name and password. You may not allow others to use your user name for access or continuation of use after your log-in. Nonmembers are not to be allowed access to any information or documents you have downloaded, except for your support staff instructed to follow these Additional Provisions to the Terms of Use. Except for information marked as publicly available or permitted for disclosure, you may not disclose information received through this portion of the Web site, except as permitted by these Provisions, and you must receive an enforceable commitment from the recipients to abide by the nondisclosure terms. Denial of Access: WSAJ reserves the right to restrict access and bar or remove an attorney or law firm from Eagle Member areas for any of the following reasons: (i) violation of Web site Terms of Use; (ii) having as part of your law practice, or of other businesses or interests, an interest that conflicts with the purposes and mission of WSAJ; (iii) filing in a proceeding a copy of an Eagle area nonpublic download or received transmission without either permission of the author or pursuant to court order entered after notice to the author and WSAJ. If you believe you or your law firm has been wrongfully denied access or barred from Eagle Member areas, you may appeal such action by sending a Request for Reconsideration to the WSAJ Executive Director. If the Executive Director denies the Request for Reconsideration, then within 30 days of the date of the written denial you may appeal to the WSAJ Executive Committee, and as part of your written appeal you may request an oral hearing. The Executive Committee’s decision on the merits of your appeal is final.

Posting Materials: Briefs, declarations, expert testimony or deposition and fact depositions may contain client confidences, client secrets or trade secrets. You must comply with outstanding confidentiality agreements or orders. You must delete material that reveals client confidences, secrets or privileged information, unless the client consents to posting or revelation of the information. You may not upload, post or transmit any of the following except as examples related to a substantive legal issue:
  • Advertisements or solicitations; to post other advertisements and solicitations that may be of interest to Eagle Members, submit them to WSAJ for posting by WSAJ.
  • Jokes, stories, anecdotes.
  • Racist, sexist or other derogatory materials that might be offensive to others.
  • Endorsements or solicitations for political candidates or causes.

Compliance With RPC: In connection with the use of this site and use of materials from this site, users must comply with the Rules of Professional Conduct for attorneys admitted to the Bar of the State of Washington.

Downloading: It is of utmost importance that you insure downloaded information and materials not be accessible to attorneys whose practice is primarily tort defense litigation. Except for material available for use publicly, you may not share any posted information, or documents obtained from or through this portion of the Web site with any law firm, attorneys or staff working for lawyers whose practice is primarily tort defense litigation. If you work in a law firm with attorneys whose practice is primarily tort defense litigation, you are required as a condition of access to this portion of the Web site to take all measures necessary to prevent those attorneys and their support staff from being able to access any download or transmission received from Eagle Member areas.

Use of Downloaded Material: No material from this site may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way that conflicts these Terms of Use.

  • Except as necessary for your use, do not share the material with persons who are not Eagle Members;
  • Do not share the “legislative” material with persons who are not Eagle Members, not even with your clients;
  • You may take excerpts from materials intended for public use, unless the materials are otherwise restricted, but you may not make modifications to the materials without the author’s consent;
  • Do not post downloaded material onto any other Web site or generally accessible networked computer;
  • Keep intact all copyright and other proprietary notices.
  • Do not file in any proceeding a copy of an Eagle area download or received transmission, unless identified as for public use, without either permission of the author or pursuant to court order entered after notice to the author and WSAJ. (A “proceeding” is any action, suit or proceeding, whether civil, criminal, administrative or investigative and whether formal or informal.)

Confidentiality and Nondisclosure: These Additional Provisions contain rules addressing the confidentiality of transmissions via this Web site and obligations of nondisclosure by users. By using the Eagle Member areas in any manner you agree to abide by the confidentiality and nondisclosure terms. This obligation continues in effect until and unless you receive permission from the source of the information to disclose it and you abide by the permitted terms and scope of disclosure. Whenever you disclose confidential information received through this Web site, it must be disclosed only as permitted by these terms and you must receive an enforceable commitment from the recipients to abide by the nondisclosure terms. Your use of Eagle areas also constitutes your acknowledgement that remedies at law may be inadequate to protect against breach of the nondisclosure provisions and that WSAJ and the users of this Web site may obtain an injunction to enforce these provisions without proof of damages. You further agree to notify WSAJ and to request that WSAJ and the authors of material at issue have an opportunity to respond if you are requested or ordered by any governmental entity to disclose confidential information obtained through Web site, and you will seek an appropriate protective order for the confidential information. Information that becomes generally known to the public or the legal community without disclosure by you is no longer deemed confidential information.

Notice and Procedure for Making Claims of Copyright Infringement

WSAJ respects the intellectual property rights of others and we ask our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, notification must be submitted to the following agent:
