Under the HITECH Act, patients can get copies of their own electronic health records (EHR) for low cost by writing a simple letter requesting the records on CD designating any recipient they choose. The HITECH Act knocks down barriers between patients and their electronic medical records that formerly existed in the HIPAA regulations. However, some health care providers and medical records contractors are violating HITECH and the HIPAA regulations by overcharging for electronic records. In this presentation, I will describe how to write a simple Patient's Letter and how to respond when health care providers and contractors violate the rules. Enforcement through the Department of Health and Human Services (DHHS), Office of Civil Rights (OCR) will be discussed. Possible paths for enforcement through state laws that are not preempted by the Federal laws and regulations will be discussed.
